Supplemental terms and conditions or documents that may be posted on TalkingPoints from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use from time to time. We will alert you about any changes by updating the "Last updated" date of these Terms of Use, and you waive any right to receive specific notice of each such change. Please ensure that you check the applicable Terms every time you use TalkingPoints so that you understand which Terms apply. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of TalkingPoints after the date such revised Terms of Use are posted.

These general terms and conditions refer to and incorporate the following additional terms, which also apply to your use of TalkingPoints. Our Search Only Terms Contract: for Access and Use of Website (available at the version-controlled URL published by MOW, currently being the following link: https://m4ow.uk/socw/2.txt) governs crawling, indexing and other automated or programmatic access to TalkingPoints and its content. If there is an inconsistency between any of the provisions of these General Terms and Conditions and the provisions of the Search Only Terms Contract: for Access and Use of Website as linked above, the provisions of the Search Only Terms Contract: for Access and Use of Website, the version hosted at the referenced MOW URL shall prevail.

Acceptance of Terms

By creating an account or using TalkingPoints, you agree to abide by these Terms of Use, our Privacy Policy, and any published TalkingPoints Guidelines. If you do not agree, you must not use TalkingPoints.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a 'terrorist supporting' country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Account Management

Users may delete their account and all associated data at any time via the 'Account deletion' option in the Profile/Help section of the TalkingPoints app. Additionally a deletion request can be manually submitted using this link talkingpoints.live/account-deletion.

User Responsibilities

You are responsible for:

Ensuring that anything you post complies with UK law.
The security of your account login details.
The accuracy of any information you provide.
Your conduct and interactions within TalkingPoints.

Legal Compliance

Users must not post any content that breaches UK laws, including but not limited to:

4.1 Defamation (Defamation Act 2013)

Do not publish false statements that harm the reputation of individuals, clubs, organisations, or public figures.

4.2 Harassment and Malicious Communications (Protection from Harassment Act 1997 & Communications Act 2003)

Threats, abusive messages, or communications intended to cause distress are prohibited.

4.3 Hate Speech and Discrimination (Equality Act 2010)

Content that targets or demeans individuals or groups based on protected characteristics (such as race, religion, sexual orientation, disability, gender reassignment, age, etc.) is strictly forbidden.

4.4 Privacy and Data Protection (Data Protection Act 2018 & UK GDPR)

Do not share others' personal data (addresses, phone numbers, images, private messages) without explicit consent.

4.5 Copyright (Copyright, Designs and Patents Act 1988)

Do not upload copyrighted material unless you have rights or permission to do so.

4.6 Incitement or Illegal Activity (Serious Crime Act 2007)

Do not encourage violence, disorder, or other unlawful behaviour, including football-related disorder.

Content Standards

All posts, messages, images, and links must adhere to the following standards:

5.1 Accuracy & Fairness

Opinions are welcome, but clearly distinguish them from factual claims.
Do not share misinformation or rumours presented as verified fact.

5.2 Safe & Appropriate Content

No explicit adult content, graphic violence, or content involving minors.
Swearing is permitted within reason, but not when directed at individuals. Certain swear words will be automatically blocked.

5.3 No Spam or Advertising

Unsolicited advertising, promotions, or link dumping is prohibited unless prior permission is granted by moderators.

Community Code of Conduct

TalkingPoints is dedicated to healthy, passionate, and respectful discussion.

6.1 Respect Others

Banter is welcome; abuse is not.
Individuals with opposing views must be treated with basic respect.
No targeted harassment of individuals, including but not limited to actors, players, referees, staff, or supporters, will be tolerated.

6.2 No Incitement of Violence or Disorder

Do not glorify violence, disorder, hooliganism, pitch invasions, or acts that endanger others.
References to violence will be removed.

6.3 Impersonation

Do not impersonate other individuals.

6.4 Misleading Content

Avoid posting unverified "ITK" (in-the-know) claims that could mislead others.

Moderation

TalkingPoints has a zero-tolerance policy for objectionable content. Users found in violation will be blocked or removed immediately. Moderators may remove content or take action at their discretion to maintain a safe and lawful environment.

Possible actions include:

Content removal
Warnings
Temporary suspension
Permanent account bans

Moderator decisions are final. Abuse directed at moderators is prohibited. We will notify law enforcement if content indicates a risk of physical harm or criminal activity.

Reporting & Blocking

If you believe another user has violated these Terms, you should report it using TalkingPoints's reporting tools. Do not attempt to resolve disputes through direct conflict. We are committed to reviewing and acting on reported content within 24 hours of receiving a report.

Users also have the ability to block other users at any time. Once a user is blocked, their content and profile will be immediately and permanently hidden from your view.

Intellectual Property Rights

9.1 Our Rights

Unless otherwise indicated, TalkingPoints is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on TalkingPoints (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United Kingdom, international copyright laws, and international conventions. The Content and the Marks are provided on TalkingPoints "AS IS" for your information and personal use only.

Except as expressly provided in these Terms of Use, no part of the Sites and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Sites, you are granted a limited licence to access and use the Sites and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Sites, the Content and the Marks.

You must adhere to all further copyright notifications, details, or constraints found in any Content you access via the Service. Using the Content for non-commercial purposes doesn't mean you can use it without obtaining prior written approval from Candr Media Group Limited for: (1) creating any software, including but not limited to training an AI or machine learning system; or (2) sharing stored, temporarily saved data sets, cached or otherwise that contain Content with another individual or organization.

9.2 Your Rights

You retain ownership of your posts, but by posting you grant TalkingPoints a non-exclusive licence to display, store, and distribute your content within the platform.

Termination of Access

We reserve the right to suspend or terminate accounts without notice for breach of these Terms or for behaviour that risks harm to the community or the platform.

Changes to These Terms

We may update these Terms from time to time. Continued use of TalkingPoints constitutes acceptance of the updated version.

"As Is" and "As Available" Service

The App and all content, including news articles, community posts, and features, are provided to you "AS IS" and "AS AVAILABLE." We make no warranties, express or implied, regarding the accuracy, completeness, or timeliness of any information published. We do not guarantee that the App will be secure, uninterrupted, or free of errors.

Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL TALKINGPOINTS BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER. This includes, without limitation:

Loss of profits, loss of data, or business interruption.
Liability arising from your reliance on news content or informational materials.
Conduct of any third parties or community members, including defamatory or illegal user-generated content.
Any damages resulting from your inability to access or use the App.

The App may contain links to third-party websites (External Services). We are not responsible for examining or evaluating the content or accuracy of these external sites. In no event shall we be financially liable to you for damages.

App Store & Google Play Specific Acknowledgements

Parties: You acknowledge that this agreement is between you and TalkingPoints only, and not with Apple Inc. or Google LLC.
Responsibility: TalkingPoints, not Apple or Google, is solely responsible for the App and its content.
Maintenance & Support: You acknowledge that neither Apple nor Google has any obligation whatsoever to furnish any maintenance or support services with respect to the App.
Claims: You agree that Apple and Google are not responsible for addressing any claims by you or any third party relating to the App, including product liability, legal non-compliance, or intellectual property infringement.
Third-Party Beneficiary: You acknowledge that Apple, Google, and their subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance, they will have the right to enforce this Agreement against you.

AI Declaration: AI-Powered Image Moderation

To maintain a safe community environment, TalkingPoints utilises automated artificial intelligence ("AI") tools specifically for the moderation of image uploads.

Scope of Use: AI is used solely to scan uploaded images for prohibited content, including illegal material, graphic violence, and sexually explicit imagery.
Privacy & Data Security: No personal user data, metadata, or account information is shared with third-party AI services for this purpose. Images are processed solely to verify compliance with our Content Standards.
No Model Training: Your images are not used to train or improve any third-party AI models.
Human Oversight: If an image is incorrectly flagged by our AI systems, users may request a manual human review by contacting our moderation team.

Independent Status & Non-Affiliation

17.1 No Official Affiliation

TalkingPoints is an independent news and community platform. You acknowledge and agree that TalkingPoints is not affiliated with, endorsed by, sponsored by, or in any way officially connected to: any professional or amateur sports team or club; any sports league or governing body (including but not limited to the Premier League, EFL, FIFA, or UEFA); or any official sports organisation, individual athlete, or public figure.

17.2 Ownership of Trademarks

All trademarks, logos, brand names, and team names mentioned on TalkingPoints are the property of their respective owners. Our use of these names and marks is for nominative and descriptive purposes only (e.g., to identify a team for news reporting or community discussion) and does not imply any association with the trademark holders.

17.3 User-Generated Content

Views expressed by community members are their own and do not represent the views of TalkingPoints or any third-party organisation. Users are prohibited from claiming or implying they have an official relationship with any sports entity while using the App.
